(1)  A person is an owner of a vehicle if the person –

(a) is the sole owner, a joint owner or a part owner of the vehicle; or

(b) has possession or use of the vehicle under a credit, hire-purchase, lease or other agreement, except an agreement requiring the vehicle to be registered in the name of someone else.

(2)  A person is the owner of a railway track if the person is responsible, by reason of ownership, control or management, for either or both of the following:

(a) the construction and maintenance of the railway track;

(b) the construction, operation or maintenance of train control and communication systems used in relation to the railway track.
