Exploration under exploration permit overrides planning schemes

189. Exploration under exploration permit overrides planning schemes



(1) The holder of an exploration permit may carry out in accordance with the
permit greenhouse gas sequestration formation exploration in the permit area-

   (a)  without obtaining a permit under the planning scheme that applies to
        the authority area; and

   (b)  without complying with any conditions specified in that planning
        scheme in relation to the use or development of that land for
        exploration.

(2) Subsection (1) applies even if the planning scheme wholly or partly
prohibits the use or development of the authority area for exploration.
