BAIL ACT 1982 - SECT 3A

3A .         Sending notices by electronic communication

        (1)         A reference in this Act, however expressed, to a notice being sent to a person (the addressee ) by electronic communication is a reference to the notice being sent by electronic communication —

            (a)         to an electronic address provided by the addressee for the purpose of being served with the notice; and

            (b)         in an electronic format that enables it to be printed or otherwise generated by the addressee.

        (2)         If a notice is sent in accordance with subsection (1), the notice is to be presumed, unless the contrary is shown, to have been received at the time when, in the ordinary course of events, the electronic communication would have entered the information system, as defined in the Electronic Transactions Act 2003 section 5, of the addressee.
