Where —
(a) a
bookmaker; or
(b) a
racing club authorised to possess and use a totalisator,
does not make payment
in respect of any money due as an annual licence fee payable under this Act
the Commission may, without prejudicing the liability of that bookmaker or
race club to pay a penalty fee under this Act, sue for the amount unpaid in a
court of competent jurisdiction.
