Western Australian Consolidated Acts (1) At the request of
a local government the Authority may appoint a member of staff (as defined in
the FESA Act) to be the Chief Bush Fire Control Officer for the district of
that local government.
(2) Where a Chief Bush
Fire Control Officer has been appointed under subsection (1) for a
district the local government is not to appoint a Chief Bush Fire Control
Officer under section 38(1).
(3) The provisions of
this Act, other than section 38(3) to (5C) apply to and in relation to
the Chief Bush Fire Control Officer appointed under this section as if he or
she were a Chief Bush Fire Control Officer appointed under section 38 by
the local government.
(4) Section 38(3)
to (5C) apply to and in relation to the Chief Bush Fire Control Officer
appointed under this section as if —
(a) he
or she were a Chief Bush Fire Control Officer appointed under section 38
by the local government; and
(b) the
references in those subsections to the local government were references to the
Authority.
