Western Australian Consolidated Acts (1) The Commission
must indemnify an officer of the Commission against any civil liability
(including reasonable costs) the officer incurs because of conduct the officer
engages in as an officer participant if —
(a) the
officer engages in the conduct in the course of, and for the purposes of, an
operation authorised by, and in accordance with, the authority for the
operation;
(b) in
the case of a controlled operation, the conduct meets the requirements of
section 130; and
(c) the
requirements specified in the regulations have been met.
(2) The Commission
must indemnify a person who is not an officer of the Commission against any
civil liability (including reasonable costs) the person incurs because of
conduct the person engages in as a civilian participant if —
(a) the
person engages in the conduct in the course of, and for the purposes of, an
operation authorised by, and in accordance with, the authority for the
operation;
(b) in
the case of a controlled operation, the conduct meets the requirements of
section 130; and
(c) the
requirements specified in the regulations have been met.
