Western Australian Consolidated Acts (1) An inspector
appointed under section 88 of the EP Act may also be appointed under that
section for the purposes of this Act.
(2) For the purposes
of this Act, an inspector has all the functions that the inspector has under
the EP Act, and for those purposes any relevant reference in the EP Act to
“this Act” is to be read and construed as if it were a reference
to this Act.
(3) In addition to the
functions of an inspector under the EP Act, an inspector may at any time, and
with any assistance the inspector may require, enter any land —
(a) in
respect of which a notice has been given under Part 4 and on that land
may do any act or thing, including the collection and removal of samples,
records or other things, which in the opinion of the inspector is necessary to
be done for determining whether or not there has been compliance with or
contravention of any notice given under Part 4; and
(b)
which is, or was, classified as contaminated — remediation required
and on that land may do any act or thing, including the collection and removal
of samples, records or other things, which in the opinion of the inspector is
necessary or will be relevant to determining responsibility for remediation.
(4) An authorised
person appointed under section 87 of the EP Act may also be appointed
under that section for the purposes of this Act.
(5) For the purposes
of this Act, an authorised person has all the functions that the person has
under the EP Act, and for those purposes any relevant reference in the EP Act
to “this Act” is to be read and construed as if it were a
reference to this Act.
(6) An analyst
appointed under section 94 of the EP Act may also be appointed under that
section for the purposes of this Act.
