EXOTIC DISEASES OF ANIMALS ACT 1993 - SECT 49

49 .         Compensation

        (1)         Subject to this Division, compensation is payable by the Minister to any person who yields up, affords or supplies anything pursuant to a requisition made under this Act, and to any person who, at that time, had an interest in that thing prejudiced by the requisitioning.

        (2)         Subject to this Division, compensation for its destruction is payable by the Minister to the owner of — 

            (a)         any domestic animal or any property which, under this Act, is destroyed for the purpose of eradicating, controlling, or preventing the spread of, an exotic disease; and

            (b)         any domestic animal that — 

                  (i)         was notified, to the Director General or to an inspector, as being affected by, or as having died of, an exotic disease; and

                  (ii)         is certified as having died of the exotic disease to which the relevant compensation order relates, by an officer authorised by the Chief Veterinary Officer.
