Western Australian Consolidated Acts (1) Where, at any
stage of an investigation, the Commissioner is satisfied that a complaint is
frivolous, vexatious, misconceived, lacking in substance or relates to an act
that is not unlawful by reason of a provision of this Act, the Commissioner
may, by notice in writing addressed to the complainant, dismiss the complaint.
(2) The Commissioner
shall, in a notice under subsection (1), advise the complainant
of —
(a) the
reason for dismissing the complaint; and
(b) the
rights of the complainant under section 90.
