Western Australian Consolidated Acts Western Australian Consolidated Acts Despite anything to
the contrary in the Local Government Act 1995 , land is not to be
regarded as being occupied for the purposes of that Act merely
because —
(a)
there is on or under that land any pipe or system of pipes for or incidental
to the transport of gas in respect of which a distribution licence has been
issued under Part 2A of the Energy Coordination Act 1994 ; or
(b) a
person is the holder of a distribution licence under Part 2A of the
Energy Coordination Act 1994 in respect of a distribution system that is
on or under that land.
