Western Australian Consolidated Acts Western Australian Consolidated Acts (1) If a body
corporate is convicted of an offence against this Act, each director and each
other person concerned in the management of the body corporate is guilty of a
like offence if the act that constituted the offence took place with his or
her authority, permission or consent.
(2) If an agent or
employee of an education institution is convicted of an offence against this
Act, the institution is guilty of a like offence unless the institution proves
that —
(a) the
offence was committed without its knowledge; and
(b) it
exercised all due diligence to prevent the commission of the offence.
