Crown land is granted subject to the right of the holder of that interest to
acquire the fee simple of the Crown land, that holder is not prevented from
creating in favour of any person an easement affecting the Crown land only
because that holder has not yet acquired that fee simple, but an easement so
created terminates if the right to acquire that fee simple is forfeited under
section 35.
