Western Australian Consolidated Acts (1) Where a licence is
held jointly and one, or more, of the persons who hold the licence no longer
wishes to be involved in the conduct of business under the licence, or ceases
to occupy the licensed premises, then application is to be made for the
licence to be transferred to the other person, or persons, who hold the
licence.
(2) Application is to
be made under subsection (1) notwithstanding that the interest of a
person in the licence has terminated under section 37(5)(b).
(3) Where application
has not been made under subsection (1) within 28 days of a person
ceasing to be involved in the conduct of business under a licence or ceasing
to occupy the licensed premises then the Director may suspend the operation of
the licence.
