Western Australian Consolidated Acts (1) If an impounded
animal is ill or injured to such an extent that treating it is not practicable
the local government may humanely destroy the animal and dispose of the
carcass.
(2) A local government
must not destroy an animal under subsection (1) unless —
(a)
because of the state of the animal, destroying it is urgent; or
(b) the
local government has —
(i)
taken reasonable steps to notify the owner; and
(ii)
whether or not notice has been given under
subparagraph (i), allowed the owner a reasonable opportunity to collect
the animal.
(3)
Subsection (2)(b) does not justify the destruction of an animal before it
has been impounded for at least 7 days.
