An official visitor
has a disqualifying interest in an association or organization if
either —
(a) the
official visitor; or
(b) a
person with whom the official visitor is closely associated,
has a financial
interest in the association or organization, other than a financial interest
of a prescribed kind.
2 . Closely associated persons
For the purposes of
this Schedule a person is closely associated with an official visitor if the
person —
(a) is
in partnership with the official visitor; or
(b) is
an employer of the official visitor; or
(c) is a
beneficiary under a trust, or an object of a discretionary trust, of which the
official visitor is a trustee; or
(d) is a
body corporate of which the official visitor is a director, secretary or
executive officer; or
(e) is a
body corporate in which the official visitor holds shares having a total
nominal value exceeding —
(i)
the prescribed amount; or
(ii)
the prescribed percentage of the total nominal value of
the issued share capital of the body corporate;
or
(f) is
the spouse, de facto partner or child of the official visitor; or
(g) has
a relationship specified in any of paragraphs (a) to (e) in respect of
the official visitor’s spouse or de facto partner.
