Western Australian Consolidated Acts (1) The Commissioner
is subject to the control and direction of the Minister, and is responsible to
the Minister for the administration of this Act and any other law relating to
occupational safety and health administered by the Minister.
(2) There shall be
appointed under and subject to Part 3 of the
Public Sector Management Act 1994 such officers as are necessary for the
administration of this Act and any law relating to occupational safety and
health administered by the Minister.
(3) The offices of
Commissioner and chief executive officer of the department may be held by the
same person.
(4) The Commissioner
may, either generally or as provided by the instrument of delegation, by
writing signed by him or her, delegate to any officer of the department any of
his or her functions under this Act other than this power of delegation, and a
function performed in accordance with a delegation under this subsection is
deemed to be performed by the Commissioner.
