Western Australian Consolidated Acts Western Australian Consolidated Acts (1) The Commission may
by notice published in the Gazette fix minimum standards of construction with
respect to roads and artificial waterways to be constructed on a proposed
subdivision.
(2) A notice published
under subsection (1) may set out particulars relating to the width,
kerbing, thickness, surfacing and foundations of roads, and the materials to
be used in the construction of roads and artificial waterways.
(3) A notice published
under subsection (1) is subsidiary legislation for the purposes of
sections 43 and 44 of the Interpretation Act 1984 .
(4) A person who
without the approval of the Commission constructs a road or artificial
waterway on a subdivision that does not comply with the standards set out in a
notice published under subsection (1) commits an offence.
