Western Australian Consolidated Acts Western Australian Consolidated Acts (1) The Minister may
by order —
(a)
declare —
(i)
a facility, or a facility of a class, specified in the
order to be a pipeline facility; or
(ii)
a pipeline, or a pipeline of a class, specified in the
order not to be a pipeline; or
(iii)
a body which is referred to in paragraph (c) of the
definition of public authority in section 4(1) and which is specified in
the order to be a public authority,
for the purposes of
this Act; or
(b)
repeal an order made under this subsection.
(2) An order made
under subsection (1) has legislative effect for the purposes of the
definition of subsidiary legislation in section 5 of the Interpretation
Act 1984 .
(3) A declaration of
the kind referred to in subsection (1)(a)(i) may be made so as to have
retrospective effect.
