Western Australian Consolidated Acts (1) There shall be an
office called the “Public Trust Office”, administered by an
officer called the Public Trustee who shall be appointed under and subject to
Part 3 of the Public Sector Management Act 1994 , and shall have and
exercise such powers and execute and discharge such duties as may be vested in
or imposed on him pursuant to the provisions herein set forth.
(2) The Public Trustee
and his successors in office shall be and continue to be a body corporate,
under the name of the “Public Trustee”, and shall by that name
have perpetual succession and a common seal, and be capable in law of suing
and being sued and of holding and disposing of real and personal property.
(3) The Public Trustee
is an agent of the Crown in right of the State and enjoys the status,
immunities and privileges of the Crown.
