PUBLIC TRUSTEE ACT 1941 - SECT 40A

40A .         Power to lease purchased land

        (1)         In this section —

        purchased land means the land described in the Sixth Schedule purchased by the Public Trustee pursuant to section 40(2a) as in force immediately before the commencement of section 25 of the Public Trustee and Trustee Companies Legislation Amendment Act 2008 ;

        unused portion means so much of the purchased land as is not used for the purposes referred to in section 39A(3).

        (2)         In addition to the powers conferred on the Public Trustee by section 39A(3) with respect to the unused portion the Public Trustee may lease the unused portion to any person approved of by the Minister on such terms and conditions as the Minister approves.
