Western Australian Consolidated Acts (1) A justice
may, on the application of the Authority, order that unclaimed property that
was seized is forfeited to the State.
(2) Unclaimed property
that was not seized is forfeited to the State at the end of the prescribed
period after it came into the possession of the Authority.
(3) The Authority may
destroy, dispose of, or otherwise deal with, forfeited property as it
considers appropriate.
(4) If anything has
been forfeited to the State under this section but it has not been destroyed,
disposed of, or otherwise dealt with in a way that would be inconsistent with
its return, the Authority may return it to a person who would have been
entitled to its possession had it not been forfeited.
(5) In this
section —
prescribed period means —
(a) for
perishable goods, a period of 24 hours;
(b) for
anything other than perishable goods, a period of 30 days;
unclaimed property means anything
that —
(a) has
been seized, found, or otherwise come into the possession of the Authority;
and
(b)
cannot be released in accordance with section 63(3) or otherwise returned
to a person entitled to its possession because a person to whom it could be
released or returned cannot be found after reasonable effort has been made.
