Western Australian Consolidated Acts (1) A retirement
village scheme cannot be terminated without the approval of the Supreme Court
while a person who has been admitted to occupation of residential premises
under the scheme remains in occupation of those premises.
(2) The Commissioner
will be a party to any proceedings in which the Supreme Court’s approval
of the termination of a retirement village scheme is sought.
(3) If the Supreme
Court approves the termination of a retirement village scheme it may make such
orders as it thinks necessary to protect the interests of existing residents.
