Western Australian Consolidated Acts (1) The Minister
may give directions in writing to the Authority with respect to the
performance of its functions, either generally or in relation to a particular
matter, and, subject to subsection (3), the Authority is to give effect
to any such direction.
(2) The Minister must
cause the text of any direction under subsection (1) to be laid before
each House of Parliament or dealt with under section 45A —
(a)
within 14 days after the direction is given; or
(b) if
the direction is the subject of a notice under section 17 of the
Statutory Corporations (Liability of Directors) Act 1996 , within
14 days after it is confirmed under that section.
(3) A direction under
subsection (1) becomes effective —
(a) on
the expiry of 7 days after its receipt by the board or of any longer
period that the Minister may, at the request of the board, determine; or
(b) if
it is the subject of a notice under section 17 of the Statutory
Corporations (Liability of Directors) Act 1996 , on its being confirmed
under that section.
(4) If the board asks
the Minister to extend the 7 day period under subsection (1), the
Minister must decide whether or not to agree to the request and notify the
board of that decision before the 7 day period has expired.
