Western Australian Consolidated Acts Western Australian Consolidated Acts (1) The Western
Australian Marine Act 1948-1980 is repealed.
(2) Part VIII of the
Merchant Shipping Act is repealed.
(3) In this Part,
Merchant Shipping
Act means the Imperial Act known as the Merchant Shipping Act 1894 , as
amended, or otherwise affected in its operation, by the provisions of any
other Imperial Act or of any Act, in so far as that Act, as so amended or
otherwise affected in its operation, is part of the law of the State.
(4) The right of a
shipowner to limit his liability in respect of a claim arising out of an
occurrence that took place before the coming into operation of this section is
not affected by the repeal of Part VIII of the Merchant Shipping Act by
subsection (2) or by the provisions of Divisions 1 and 4 of
Part IV of this Act.
