(1) The Minister is
charged with the duty of protecting the public health and safety against the
dangers of radiation, but is required at all times to have regard to the
expressed views of the Radiological Council.
(2) Subject to the
general direction of the Minister, the function of the Council is to
administer this Act and in particular —
(a) to
implement the scheme of licensing and the scheme of registration created by or
under this Act; and
(b) to
conduct inquiries into alleged contraventions, and to suspend or cancel
licences and registrations; and
(c) to
advise the Minister, and to make recommendations, with respect to the
technical aspects of radiation safety requirements and as to the methods to be
used for the purpose of preventing or minimising the dangers arising from
radioactive substances, irradiating apparatus and electronic products,
including the preparation of regulations; and
(d) to
investigate and prosecute offences against this Act.
(3) For the purposes
of this Act, the Council has all such powers, rights and privileges as may be
reasonably necessary to enable it to carry out its functions.
(4) The cost of the
administration of this Act shall be paid out of the moneys to be from time to
time appropriated by Parliament for the purpose.
