Western Australian Consolidated Regulations (1) The awarding of
the costs of and incidental to an appeal is in the discretion of the Court.
(2) On determining an
appeal the Court may fix the amount of costs but otherwise they are to be
taxed in accordance with determinations made by the Legal Costs Committee
under the Legal Practice Act 2003 4 and section 215 of that
Act.
(3) On determining an
appeal, the Court may make any order as to any money paid to the Court as
security for costs that is just having regard to any order made as to costs.
(4) If the Court does
not make an order under subrule (3), a legally qualified registrar may make
such an order at any time.
