Western Australian Consolidated Regulations (1) Before an
explosive is used to blast rock or similar solid material, or to damage,
destroy or demolish any thing, whether on or under land or water, each of the
following persons must prepare a blast plan for the use of the explosive or
ensure that such a plan has been prepared —
(a) the
person who will use the explosive (the shotfirer );
(b) the
person for whom the shotfirer will be working at the time, whether under a
contract for services or a contract of service;
(c) the
person who has the control and management of the work that necessitates the
use of the explosive;
(d) the
person who has the control and management of the place where the explosive is
used.
Note: under r. 192 a blast plan is a “safety
management document” under the Act and accordingly the Act s. 10 (among
others) applies in respect of it.
(2) This regulation
does not apply to the use of an explosive in the 12 months that begin on the
day on which this regulation comes into operation.
