Western Australian Consolidated Regulations (1) In this
regulation —
affected person means a person adversely affected
by alcohol or a drug to an extent that is likely to increase the risk to
people (including the affected person), property or the environment in
relation to any explosive near the person or that the person might handle.
(2) A person in
possession of an explosive who reasonably suspects that a person in the
vicinity of the explosive is an affected person, may order the person to leave
the vicinity.
(3) A person given an
order under subregulation (2) must obey it.
(4) An affected person
must not be on an explosives site.
(5) An affected person
must not handle an explosive.
(6) An affected person
must not be on a vehicle transporting an explosive.
Penalty: a level 2 fine.
