Western Australian Consolidated Regulations An applicant for a
mining tenement may, at any time before the granting of the application, apply
to withdraw his application by lodging a withdrawal in the form of
Form 22, but if —
(a) the
land in respect of which the application is made is private land; and
(b) the
owner, or occupier, of the private land referred to in paragraph (a) has
lodged an objection to the application,
the application shall
not be withdrawn without leave of the warden at the hearing of the
application.
