Western Australian Consolidated Regulations (1) Subject to these
by‑laws, a person shall site a Class 1 Building on a lot in such a
manner that —
(a) the
external walls of the building facing the rear boundary of the lot have an
average distance of not less than 7.5 m from that boundary;
(b) any
external walls of the building (including a footing wall), other than the
walls facing the rear boundary of the lot and the walls facing the frontage,
is not less than —
(i)
where the floor of the lowest storey of the building is
not more than 1 800 mm above the ground level at that
point — 900 mm;
(ii)
where the floor of the lowest storey is more than
1 800 mm above the ground level at that
point —3 300 mm;
(c)
reasonable access to the rear of the lot is provided by a driveway having a
width of not less than 2 400 mm, unless provision is made in the
building itself for a garage; and
(d)
provision is made behind the building line for the parking or standing of a
motor vehicle either in the form of a garage or carport that conforms with
these by‑laws.
(2) The calculation of
set back distances for the purposes of sub‑bylaw (1) shall be in
accordance with the Statement of Planning and Policy No. 1, and the
council may in accordance with that Statement permit the construction of a
Class 1 Building the siting of which does not conform with
sub‑bylaw (1) if the council is satisfied that the variation is
desirable.
