Western Australian Numbered Acts (1) Subject to
subsection (3), a person must not directly or indirectly control the
exercise of the right to vote of a member.
Penalty: a fine of $12 000.
(2) If a person
controls the exercise of the right to vote of a member at a meeting of a
co-operative —
(a) the
vote of the member is invalid; and
(b) if
the person is a member, the vote of the person is invalid.
(3) Nothing in this
section prevents —
(a) the
exercise of a vote by means of a proxy or power of attorney; or
(b) a
director controlling the vote of a corporate member; or
(c) an
agreed purchaser controlling a member’s vote pending settlement.
