Western Australian Numbered Acts Sections 436 and 437
are repealed and the following sections are inserted instead —
Any person who
unlawfully uses any article or substance for the purpose of taking any aquatic
organism that is being reared by aquaculture in a place that is the property
of, or under the control of, any person is guilty of a simple offence and is
liable to imprisonment for 2 years or a fine of $8 000.
437. Unlawfully taking fish etc.
Any person who
unlawfully takes or destroys, or attempts to take or destroy, any aquatic
organism that is —
(a)
being reared by aquaculture in a place that is the property of, or under the
control of, any person; or
(b) in
any water that is private property or in which there is a private right of
fishery,
is guilty of a simple
offence and is liable to imprisonment for 2 years or a fine of
$8 000.
