Western Australian Numbered Acts (1) If a remediation
notice has been given to a person and the person has not complied with it, a
DGO may take the measures specified in the notice.
(2) For the purposes
of subsection (1), a DGO may —
(a)
enter and take possession of a place or vehicle;
(b)
seize, move or destroy or otherwise dispose of any dangerous goods; and
(c) take
any other action that is reasonably necessary and incidental.
(3) A DGO’s
powers under this section are in addition to the other powers of a DGO under
this Act.
(4) The Crown may
recover from a person who did not comply with a remediation notice, as a debt
in a court of competent jurisdiction, the reasonable costs and expenses
incurred by a DGO, or any person acting at the request of a DGO, in exercising
the powers under this section.
