Western Australian Numbered Acts (1) Subject to
section 9, the Authority must grant, renew or approve the transfer of a
licence if it is satisfied that the applicant —
(a) has,
and is likely to retain; or
(b) will
acquire within a reasonable time after the grant, renewal or transfer, and is
then likely to retain,
the financial and
technical resources to undertake the activities authorised, or to be
authorised, by the licence.
(2) The Authority must
take all reasonable steps to make a decision in respect of an application
for —
(a) the
grant or renewal of a licence; or
(b)
approval to transfer a licence,
within 90 days
after the application is made.
(3) The duties imposed
on the Authority by subsections (1) and (2) apply only
if —
(a) an
application has been made in accordance with section 10, 16
or 18, as the case may be;
(b)
section 50 or 100 does not prohibit the grant or renewal of the
licence or the approval of the transfer; and
(c)
where a requirement has been made under section 10(2), 16(2)
or 18(4), the relevant information has been provided to the Authority.
