Western Australian Numbered Acts Western Australian Numbered Acts Section 38(1) and
(2) are repealed and the following subsection is inserted instead —
“
(1) Without affecting
the right of challenge to the array or for cause shown which might have been
claimed or exercised immediately prior to the coming into operation of this
Act, any party at any criminal trial (including those prosecuting for the
Crown) may challenge 5 jurors peremptorily.
