Western Australian Numbered Acts (1) If there is no
sufficient provision in this Part for any matter or thing necessary or
convenient to give effect to the purposes of this Part, that provision may be
made by regulations.
(2) If in the opinion
of the Minister an anomaly arises in the operation of any provision continued
in force by section 105(1), the Governor may by
regulations —
(a)
modify that provision to remove the anomaly; and
(b) make
such provision as is necessary or expedient to achieve the purposes referred
to in subsection (1) in the intended manner.
(3) If regulations
under subsection (1) provide that a state of affairs is to be taken to
have existed, or not to have existed, on and from a day that is —
(a)
earlier than the day on which the regulations are published in the Gazette ;
but
(b) not
earlier than the day on which this Part came into operation,
the regulations have
effect according to their terms.
(4) A provision
referred to in subsection (3) does not operate so as —
(a) to
affect in a manner prejudicial to any person (other than the State) the rights
of that person existing; or
(b) to
impose liabilities on any person (other than the State) in respect of anything
done or omitted to be done,
before the day of
publication of the regulations.
