Legal Practitioners Amendment Bill 2002





A Bill for

An Act to amend the Legal Practitioners Act 1970











The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Legal Practitioners Amendment Act 2002.

2 Commencement

This Act commences on 1 October 2002.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act 2001, s 75).

3 Act amended

This Act amends the Legal Practitioners Act 1970.

4 New section 196A

insert

196A Advertising restriction

(1) A solicitor must not advertise in a way that suggests the solicitor will not charge costs as between the solicitor and a client if the client’s litigation is unsuccessful.

Example

an advertisement containing the expression ‘no win, no fee’

Note An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears (see Legislation Act 2001, s 126 and s 132).

(2) For this section:

advertise includes make a statement on the solicitor’s letterhead or any other document that identifies the solicitor.
