units
Section 133 (1)
substitute
(1) In a law, if a penalty for an offence is expressed as a number
(whether whole or fractional) of penalty units, the penalty for the offence is a
fine of that number of penalty units.
(1A) A penalty unit is—
(a) for an offence committed by an individual—$110; or
(b) for an offence committed by a corporation—$550.
Example
‘Maximum penalty: 10 penalty units.’ means that a person who is
convicted of the relevant offence is liable to a maximum fine of 10 penalty
units.
• If the person is an individual, the maximum fine is, therefore, $1
100 ($110 x 10).
• If the person is a corporation, the maximum fine is, therefore, $5
500 ($550 x 10).
Note An example is part of the Act, is not exhaustive and may
extend, but does not limit, the meaning of the provision in which it appears
(see s 126 and s 132).
