To validate certain actions under
the Planning Act

1. SHORT TITLE
   

This Act may be cited as the Planning (Validation) Act 1984.

1. REFERENCE TO PLANNING ACT
   

In this Act, a reference to the "Planning Act" is a reference to the Planning Act as in force at the time that an action is taken but, in any case, not later than 28 August 1984.

1. VALIDATION
   

(1) Where on or after 18 January 1984 notice of a draft planning instrument was published for the first time under section 47(2) of the Planning Act and the period for submissions under section 49 of the Planning Act expired, or purportedly expired, on or before 28 August 1984, neither the notice nor the draft planning instrument is invalid by reason of a failure -

(a) to publish the notice not less than 4 times in accordance with section 47(2)(b) of the Planning Act;

(b) to exhibit the draft planning instrument in compliance with section 48 of the Planning Act; or

(c) both to so publish and exhibit.

(2) Where, by virtue of sub-section (1), a notice or draft planning instrument is not invalid, all actions taken in reliance on the validity of the notice or draft planning instrument or both are as effective as they would have been if -

(a) the notice had been published not less than 4 times in accordance with section 47(2)(b) of the Planning Act;

(b) the draft planning instrument had been exhibited in compliance with section 48 of the Planning Act; or

(c) the notice had been published not less than 4 times in accordance with section 47(2)(b), and the draft planning instrument had been exhibited in compliance with section 48, of the Planning Act,

as the case may be.
