The Parliament of South Australia enacts
as follows:
This Act may be cited as the Natural Resources Management
(Transfer of Water Licences) Amendment Act 2006.
This Act will come into operation on a day to be fixed by
proclamation.
In this Act, a provision under a heading referring to the
amendment of a specified Act amends the Act so specified.
Part 2—Amendment of Natural Resources Management
Act 2004
4—Amendment of section 157—Transfer
Section 157(9)—delete subsection (9) and
substitute:
(9) Despite the provisions of the Stamp
Duties Act 1923, if the transfer of a licence, or of the whole or part
of the water allocation of a licence—
(a) is expressed to be for a period not exceeding 5 years
(including any rights of extension under the instrument of transfer); or
(b) falls within the ambit of a regulation made for the purposes
of this subsection,
the transfer (and, in a case where paragraph (a) applies, the subsequent transfer back to the original transferor at the end of the relevant period) is not chargeable with duty under that Act.
