PUBLIC SECTOR SUPERANNUATION REFORM REGULATIONS 1999 (S.R. 1999, NO. 184) - REG 3

Eligibility to contribute to contributory scheme
(1)  A person –
(a) appointed as a temporary employee on or after 16 May 1997 but before 15 May 1999; and
(b) continuously so employed since that appointment; and
(c) subsequently appointed as a permanent employee on or after 15 May 1999 but within 3 years after his or her appointment as a temporary employee –
may elect in writing to the Board to contribute to the contributory scheme on and from the date of that person's appointment as a permanent employee.
(2)  An election under subregulation (1) is to be made –
(a) within 3 months of the person's appointment as a permanent employee; or
(b) within 3 months after the Board is notified of the person's appointment as a permanent employee –
whichever is the later.
(3)  The application of this regulation extends to a person –
(a) appointed as a temporary employee on or after 16 May 1997 but before 15 May 1999; and
(b) subsequently appointed as a permanent employee before the day on which these regulations take effect.
(4)  A person to whom subregulation (3) applies must make an election –
(a) within 3 months after these regulations take effect; or
(b) within 3 months after the Board is notified of the person's appointment as a permanent employee –
whichever is the later.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations make provision with respect to the eligibility of certain temporary employees to contribute to the contributory scheme on their appointment as a permanent employee.
