Exemption for work done for public sector agencies
103E Exemption for work done for public sector agencies
(1) This Part does not apply to or in respect of residential building work
done by or on behalf of the Crown or a State owned corporation.
(2) If the
residential building work is being done under a contract, the exemption from
this Part will not apply unless the contract under which the work is carried
out specifies that the person is relying on the exemption under this section.
(3) The regulations may specify that the exemption does not apply in the
circumstances specified by the regulations and may impose conditions on the
exemption.
(4) Regulations may be made for or with respect to the inclusion
of consumer warnings in contracts for the sale of land on which
residential building work was carried out by a person who was subject to the
exemption.
(5) In this section--
"Crown" has the same meaning as in the Crown Proceedings Act 1988 .
