Search warrants
126A Search warrants
(1) An authorised person may apply to an issuing officer for a search warrant
if the applicant has reasonable grounds for believing that a provision of this
Act or the regulations has been or is being contravened on premises.
(2) An
issuing officer to whom an application for a search warrant is made under this
section may, if satisfied that there are reasonable grounds for doing so,
issue a search warrant authorising an authorised person named in the warrant
and any other person named in the warrant-- (a) to enter the premises
concerned, and
(b) to search the premises for evidence of a contravention of
this Act or the regulations.
(3) A police officer may accompany an
authorised person who enters premises and searches for evidence under a search
warrant as if the police officer were named in the warrant.
(4) Division 4 of
Part 5 of the Law Enforcement (Powers and Responsibilities) Act 2002 applies
to a search warrant issued under this section.
(5) In this section--
"authorised person" means a person authorised to enter premises by
section 126.
"issuing officer" means an authorised officer within the meaning of the Law
Enforcement (Powers and Responsibilities) Act 2002 .
