Secretary may carry out inquiries and investigations
35A Secretary may carry out inquiries and investigations
(1) The Secretary may carry out such investigations and inquiries as the
Secretary considers necessary in connection with-- (a) a complaint or proposed
complaint under Part 6A in relation to the secretary, or a member of the
governing body, of a registered club, or
(b) compliance with the provisions
of Part 4A (including the provisions of the
Registered Clubs Accountability Code) by a registered club or member of the
governing body or employee of a registered club.
(2) The Commissioner of
Police is to inquire into, and report to the Secretary on, such matters as the
Secretary may request concerning a person who is the subject of an
investigation under this section.
(3) The Secretary may, by notice in
writing, require a person who is the subject of an investigation under this
section, or is a member of the governing body of or an employee of a
registered club that is the subject of such an investigation, to do one or
more of the following things-- (a) provide, in accordance with directions in
the notice, such information verified by statutory declaration as, in the
opinion of the Secretary, is relevant to the investigation and is specified in
the notice,
(b) produce, in accordance with directions in the notice, such
records as, in the opinion of the Secretary, are relevant to the investigation
and permit examination of the records, the taking of extracts from them and
the making of copies of them,
(c) authorise a person described in the notice
to comply with a requirement of the kind referred to in paragraph (a) or (b),
(d) furnish to the Secretary such authorities and consents as the Secretary
requires for the purpose of enabling the Secretary to obtain information
(including financial and other confidential information) from other persons
concerning the person under investigation and his or her associates.
(4) A
person who complies with a requirement of a notice under this section does not
on that account incur a liability to another person.
(5) A person must not
fail to comply with a requirement of the Secretary contained in a notice under
subsection (3). Maximum penalty (subsection (5)): 20 penalty units.
