Information notice about forfeiture
155 Information notice about forfeiture
(1) If the chief executive decides, under section 154 (2) , to forfeit an
animal or other thing, other than a seized thing mentioned in section 150 (1)
(c) , the chief executive must promptly give the person who owned it
immediately before the forfeiture (the
"former owner" ) an information notice about the decision.
(2) However,
subsection (1) does not apply if— (a) the decision was made under
section 154 (2) (a) or (b) ; and
(b) the place where the animal or other
thing was seized is— (i) a public place; or
(ii) a place at which the
notice is unlikely to be read by the former owner.
(3) The information notice
must state that the former owner may apply for a stay of the decision if he or
she appeals against the decision.
(4) If the decision was made under
section 154 (2) (a) or (b) the information notice may be given by leaving it
at the place where the animal or other thing was seized, in a conspicuous
position and in a reasonably secure way.
