Order against owner in certain cases
184 Order against owner in certain cases
(1) This section applies if— (a) a person has been convicted of an animal
welfare offence; and
(b) someone else (the
"owner" ) owns the animal the subject of the offence.
(2) The court may make
a disposal or prohibition order against the owner as if the owner had been
convicted of the offence if the court considers— (a) an act done, or
omission made, by the owner contributed to, or allowed, the commission of the
offence; and
(b) the owner is, and will continue to be, incapable of
exercising the owner’s duty of care to the animal.
