Advance notice of intention to rely on expert evidence under s 348A
590BA Advance notice of intention to rely on expert evidence under s 348A
(1) If an accused person intends to adduce expert evidence under section 348A
(6) in the person’s trial, the accused person must, within the
prescribed period, give notice of that intention.
(2) If the accused person
does not give notice as required by subsection (1) , the accused person may
not, without the leave of the court, adduce the expert evidence.
(3) A notice
under this section— (a) must be in writing; and
(b) must be given to the
director of public prosecutions; and
(c) is taken to be given if it is
delivered to or left at the Office of the Director of Public Prosecutions or
sent by certified mail addressed to the director of public prosecutions at the
director’s office.
(4) In this section—
"prescribed period" means the period of 14 days after the date of the
committal for trial of the accused person.
