Offence to trespass—landholders’ rights
100 Offence to trespass—landholders’ rights
(1) This section applies to a person who a landholder suspects on reasonable
grounds— (a) is trespassing on the landholder’s land; and
(b) is
committing on the land, has committed on the land or is on the land for the
purpose of committing, an offence against this Act.
(2) The landholder may—
(a) require the person to state— (i) the person’s name and address; and
(ii) the person’s purpose for being on the land; and
(b) if the person is
on the land without lawful authority—require the person to leave the land
immediately.
(3) If— (a) the person fails to give— (i) his or her name
and address; or
(ii) the person’s purpose for being on the land;
if
required to do so by the landholder; or
(b) the person— (i) is on the land
without lawful authority; and
(ii) fails to leave the land immediately if
required to do so by the landholder;
the person commits an offence against
this Act. Penalty— Maximum penalty—165 penalty units.
(4) This
section does not affect any other right or remedy that the landholder may have
against the trespasser.
