Entry and search—monitoring compliance
145 Entry and search—monitoring compliance
(1) Subject to subsection (2) , a conservation officer may, for the purpose of
finding out whether this Act is being complied with— (a) enter any place at
any reasonable time of the day or night; and
(b) exercise the powers set out
in section 147 .
(2) The conservation officer must not enter a place, or
exercise a power under subsection (1) , unless— (a) the occupier of the
place consents to the entry or exercise of the power; or
(b) a warrant under
section 148 authorises the entry or exercise of the power; or
(c) the place
is a place to which the public are admitted (whether or not for consideration)
and the entry is made when members of the public attend or the premises are
open for admission by the public; or
(d) the place is premises, or the part
of premises, that— (i) are licensed under a regulation and the entry is made
when the premises are open for conduct of business or otherwise open for
entry; and
(ii) are not used exclusively for residential purposes.
(3) In
this section—
"place" does not include a vehicle, boat or aircraft.
