289 Provisional improvement notices preserved

(1) Subsection (2) applies to the following in force immediately before the repeal of the repealed Act—

(a) a provisional improvement notice given under the repealed Act, section 81B for a contravention or likely contravention of the repealed Act (the
"old contravention" );

(b) a provisional improvement notice mentioned in paragraph (a) affirmed (with or without changes) by an inspector under the repealed Act, section 81I .

(2) The provisional improvement notice continues to be enforceable against the person to whom it was given for a contravention of the repealed Act, section 81F , 81G or 81I (4) that happened before the repeal as if the repealed Act had not been repealed.

(3) Also, the provisional improvement notice continues in force and may be enforced as if it were a provisional improvement notice given to the person under section 90 of this Act for a contravention of a provision of this Act that corresponds to the old contravention.
